This website is operated by Camille Reau. Throughout the site, the terms “we”, “us” and “our” refer to Camille Reau. Camille Reau offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

Registration

In order to access certain services on camillereau.com, you must be over eighteen (18) years of age.  Further, you may be required to provide specific information to us about you, either directly or through a single-sign on process using third party credentials.  All information about you must be truthful, accurate, current and complete at all times and you may not use any aliases or other means to mask your true identity. Any access codes or passwords provided should be safeguarded at all times. You are responsible for the security of your access codes and passwords and will be solely liable for any use under such access codes or passwords. We may suspend or terminate your access at any time for any reason with or without notice.

Fees; Payment; Return Policy

Certain products offered by (or on behalf of) Camille Reau through the Site (such as hats, scarves and/or other accessories) will require payment by you (“Products”). You shall pay all applicable fees, as described on the Site, in connection with the Products selected by you. All fees are in U.S. dollars unless stated otherwise by Camille Reau on the Site. All fees are payable upon demand on a Visa, MasterCard, American Express, Discover credit card. Camille Reau reserves the right to change its prices (and to institute new charges) for the Products at any time. Purchases by you following the posting of such changes on the Site constitutes your acceptance of any new or increased charges.
Purchases are subject to Camille Reau’s Shipping and Returns Policy.

Privacy

Your Camille Reau account Personal Information is protected by a password for your privacy and security. You need to ensure that there is no unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer and browser by signing off after you have finished accessing your account.

Camille Reau endeavors to protect user information to ensure that user account information is kept private, however, Camille Reau cannot guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Camille Reau takes the privacy of its users very seriously. Please refer to our Privacy Policy for further detail.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13 and the EU General Data Protection Regulation (“GDPR”) prohibits collecting information from children who are under 16. Camille Reau does not knowingly collect or solicit personally identifiable information from children under 16; if you are a child under 16, please do not attempt to register with Camille Reau or send any personal information about yourself to Camille Reau. If Camille Reau learns it has collected personal information from a child under 16, Camille Reau will delete that information as quickly as possible. Harvests or collects any information from the Site; or

Camille Reau may, at its sole discretion, immediately terminate your access to the Service should your conduct fail to conform strictly with any provision of this section.

These additional sites are not under Camille Reau’s control, nor does Camille Reau endorse any websites, social media platforms, services or content. Indemnification

You agree to indemnify, defend and hold harmless Camille Reau and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

We are either the owners of or otherwise licensed to use all parts of the Website, including all copy, software, graphics, photographs, videos, articles, designs and all copyrights, trademarks, service marks, trade names, logos, and other intellectual property or proprietary rights contained therein. Some materials on the Website belong to third parties or other Website users.  Unless we permit you to upload or share a specific item within the Website, you agree not to copy, distribute, modify or make derivative works of any materials without the prior written consent of the owner of such materials. Except as expressly set forth in these Terms and Conditions, no license is granted to you and no rights are conveyed by virtue of accessing or using the Website.  All rights not granted under these Terms and Conditions are reserved by us.

Termination

Camille Reau may terminate your access to all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you choose to terminate your account, you may notify us that you no longer wish to use our Services, or simply cease to use our site. Any and all obligations/liabilities incurred prior to the termination date shall survive the termination of this agreement in perpetuity or until settled.

No Warranties

The service (including, without limitation, all content and products available through the service) is provided “as is” and “as available” and without warranty of any kind, express or implied, including, but not limited to, the implied warranties of title, non-infringement, merchantability and fitness for a particular purpose, and any warranties implied by any course of performance or usage of trade, all of which are expressly disclaimed. Camille Reau, and its directors, employees, agents, suppliers, partners and content providers do not warrant that: (A) The service will be secure or available at any particular time or location; (B) Any defects or errors will be corrected; (C) Any content or software available at or through the service is free of viruses or other harmful components; or (D) The results of using the service will meet your requirements. Some states do not allow the exclusion of certain warranties, so the above exclusions may not apply to you.

Limitation of Liability

We do not guarantee, represent or certify that your use of our service will be uninterrupted, timely, secure or error-free.

We do not certify that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Camille Reau, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

E-Commerce Terms

In addition to these Terms and Conditions, all purchases of Camille Reau products are also governed by our return, exchange, and repair policies. The terms, privacy policies and other conditions of our merchant, e-commerce and payments provider Shopify (“Shopify Terms”).  Please review all Shipping and Returns Policies and Shopify Terms before purchasing a product from or entering into any transaction with Camille Reau.  By purchasing a product from or entering into any transaction with Camille Reau, you agree to and accept the E-Commerce Policies and Shopify Terms.

International Use

Camille Reau makes no representation that the substance is appropriate or available for use in locations outside the United States. If accessing the service is prohibited from regions where such content is illegal, you do so at your own initiative and are responsible for compliance with local laws. Currently, Camille Reau does not provide services outside of the United States.

Dispute Resolution

A printed version of these Terms of Use and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You and Camille Reau agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, excluding its conflicts of law rules, and the United States of America. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Use or your use of this Site or Services shall be filed only in the state or federal courts located in California, USA, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. Use of the Service is not authorized in any jurisdiction that does not give effect to all provisions of these Terms of Use, including without limitation, this section.

Severability

If any part of these Terms and Conditions shall be held or declared to be invalid or unenforceable for any reason by any court of competent jurisdiction, such provision shall be ineffective but shall not affect any other part of these Terms and Conditions, and in such event, such provision shall be changed and interpreted so as to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.
